1. Accepting These Terms

By creating an account or using Havyn, you agree to these terms. If you don't agree, please don't use the app.

Who Can Use Havyn:

• You must be at least 18 years old
• You must be a parent, guardian, or someone authorized to search for childcare
• You must provide accurate information
• You must comply with Irish and EU laws

2. What Havyn Does (And Doesn't Do)

What We Provide

• Search Tool: Find creches near you with filters for age, location, etc.
• Tracking Tool: Keep track of which creches you've contacted and when to follow up
• Reminder Tool: Get notifications when it's time to follow up
• Information: Basic details about creches (name, location, contact info)

What We DON'T Provide

• A booking service (we don't reserve spots for you)
• A creche (we don't provide childcare)
• A recommendation service (we don't endorse specific creches)
• A guarantee (we can't promise you'll get a spot)
• A background check service (we don't verify creche quality or safety)

You are responsible for: Contacting creches yourself, visiting them, checking their Tusla registration, asking about availability, and making your own decision about which creche is right for you.

3. Your Account Responsibilities

Account Security

• Keep your password secure
• Don't share your account with others
• Let us know immediately if your account is compromised
• You're responsible for all activity on your account

Accurate Information

• Provide a real email address we can reach you at
• Don't create multiple accounts to abuse the service
• Update your information if it changes

Acceptable Use

You agree NOT to:

• Use the app for any illegal purpose
• Harass, abuse, or spam creches
• Try to hack, break, or reverse-engineer the app
• Copy or scrape creche data for commercial purposes
• Impersonate someone else
• Upload viruses or malicious code

4. Subscription & Payment

Free Features

Havyn's core features are free forever:

• Search for creches
• Track up to 10 applications
• Set follow-up reminders
• View creche contact information

Premium Features (Optional)

If we introduce premium features in the future:

• Pricing will be clearly shown before purchase
• Subscriptions auto-renew unless you cancel
• You can cancel anytime from Settings
• Refunds are handled according to Apple's/Google's policies

Cancellation

You can delete your account anytime from Settings → Account → Delete Account. All your data will be permanently deleted within 30 days.

5. Creche Information & Accuracy

Where We Get Data

We collect creche information from:

• Publicly available sources (websites, directories)
• Tusla registration database
• Direct submissions from creches

Accuracy Disclaimer

• Availability and waiting lists
• Prices and fees
• Opening hours and services
• Tusla registration status
• Staff qualifications

We are not responsible for incorrect information, changes in creche availability, or the quality/safety of any creche.

6. Ownership & Intellectual Property

What We Own

• The Havyn app, website, and design
• Our logo, branding, and content
• The code and technology behind the service

What You Own

• Your notes and tracking data
• Your search history and preferences

You can export your data anytime from Settings → Data & Privacy → Export Data.

7. Limitation of Liability

Please Read Carefully:

Service "As Is"

Havyn is provided "as is" without warranties. We work hard to keep the app running smoothly, but we can't guarantee:

• The app will always be available (servers go down, maintenance happens)
• The data will always be accurate or up-to-date
• The app will work on all devices perfectly
• You'll find a creche spot (that's up to the creches)

What We're Not Responsible For

• Creches not responding to your applications
• Missing a follow-up because the app didn't send a notification
• Incorrect creche information leading to wasted time
• Any issues with the creches themselves (quality, safety, availability)
• Lost data due to technical issues (though we back up regularly)
• Your phone losing internet connection

Maximum Liability

If we are found liable for anything, our liability is limited to the amount you paid us in the last 12 months (which is €0 for free users).

This sounds harsh, but: We're a small startup helping parents for free. We do our best, but we can't be held responsible for things outside our control.

8. Disputes & Governing Law

Irish Law Applies

These terms are governed by the laws of Ireland. Any disputes will be resolved in Irish courts.

Before Suing Us

If you have a problem, please contact us first at support@get-havyn.com. We'll do our best to resolve it quickly and fairly.

9. Changes to These Terms

We may update these terms occasionally. If we make significant changes:

• We'll email you at least 30 days before changes take effect
• We'll show a notification in the app
• You'll have a chance to review and accept (or delete your account)

Minor changes (typos, clarifications) may happen without notice. The "Last Updated" date shows when changes were made.

10. Ending Your Account

You Can Leave Anytime

Delete your account from Settings → Account → Delete Account. No questions asked, no cancellation fees.

We Can Terminate Your Account If:

• You violate these terms
• You abuse the service or harass creches
• You try to hack or damage the app
• We're required to by law

If we terminate your account, we'll try to email you first (unless it's for legal/safety reasons).
